Terms and Conditions

Effective May 1, 2026.
These Terms and Conditions (hereinafter Terms) govern access to and use of the GutUp platform, available at gutup.ch, published by GutUp Sàrl, a Swiss limited liability company located at Rue de Bourg 27, 1003 Lausanne, Canton of Vaud. By accessing the platform and creating an account, you accept these Terms in their entirety.
Definitions
- Platform: the website gutup.ch and all its subdomains
- GutUp Sàrl: the company publishing the platform
- Expert: nutritionist, dietitian or wellness professional registered as a B2B partner
- Producer / Brand: food producer or brand listed on the platform
- Spot: physical establishment listed on the platform
- B2C User: any individual using the platform for personal purposes
- Editorial Content: recipes, advice, articles and photos published by Experts
- Commercial Content: product sheets, visuals and descriptions published by Producers
Content ownership and licences
1.1 Expert editorial content
The Expert remains the author and owner of all editorial content published on GutUp. By publishing content, the Expert grants GutUp Sàrl a non-exclusive, non-transferable licence, valid for the duration of their subscription and beyond under the conditions set out in Article 1.4, covering display on gutup.ch and promotion across all GutUp Sàrl communication channels, with mandatory credit to the Expert by name.
GutUp Sàrl undertakes never to attribute an Expert's content to another person, and not to modify it in a way that damages their professional reputation.
1.2 Producer commercial content
The Producer remains the owner of their product sheets, visuals, brand descriptions and nutritional information. By publishing them on GutUp, the Producer grants GutUp Sàrl a non-exclusive licence covering display on gutup.ch and promotion across all GutUp Sàrl communication channels.
1.3 Spot and B2C User content
Spots and B2C Users grant GutUp Sàrl a non-exclusive display licence over their content for the duration of their use of the platform.
1.4 Content retention after termination
By publishing content on GutUp, the Expert grants GutUp Sàrl a perpetual and irrevocable licence to use that content for the purposes of operating the platform, including after account termination, subject to the following rules:
- Expert terminated, partner product active: recipe retained, anonymised under the GutUp brand
- Producer terminated, recipe active: brand mention automatically replaced by a generic designation
- Both Expert and Producer terminated: recipe anonymised and generic designation applied
- Expert requests express deletion: full deletion within 30 days
1.5 Visibility conditional on active subscription
The named mention of a product or brand is conditional on the Producer maintaining an active subscription. Upon termination, all mentions are automatically replaced by a generic designation and the product becomes non-clickable.
1.6 Mentions of unlisted brands
An Expert wishing to mention an unlisted brand must submit a request via their dashboard. GutUp Sàrl will review within an indicative period of 5 business days and reserves the right to refuse without giving reasons.
Medical disclaimer
GutUp Sàrl is an information and matchmaking platform in the field of nutrition. It does not constitute a medical device, a health service, or an emergency service within the meaning of Swiss law (LPTh, OAMéd).
Content available on GutUp is exclusively informative and educational. It does not constitute a medical diagnosis, a therapeutic prescription or recommendation, personalised medical advice, or a substitute for consultation with a qualified healthcare professional.
GutUp expressly advises against using its content as an exclusive dietary guide for people with a history of eating disorders, pregnant or breastfeeding women, people on medication, people with diagnosed digestive conditions, and minors without parental supervision.
In a medical emergency, call 144 (Switzerland) or 112. Never delay consulting a doctor because of information read on GutUp.
GutUp Sàrl accepts no liability for any direct or indirect damage resulting from the use of its content for medical or therapeutic purposes.
Health claims and EFSA/FOSCO compliance
GutUp Sàrl operates within the framework of Regulation (EC) No 1924/2006 on nutrition and health claims, as applied in Switzerland by the FOSCO and the Swiss Food Act.
- GutUp Sàrl only publishes claims authorised under EFSA Art. 13 in its own editorial content
- Experts undertake to comply with the EFSA/FOSCO register in their publications
- Producers guarantee the FOSCO compliance of all their product claims and bear full responsibility for them
References to scientific studies or publications are provided for documentation purposes only. GutUp Sàrl does not guarantee their completeness or the interpretation that may be drawn from them. They do not constitute health claims within the meaning of Regulation (EC) No 1924/2006.
Any content containing an unauthorised claim reported to GutUp Sàrl will be addressed within 5 business days. In the event of a repeat offence, the Expert's or Producer's account may be suspended without notice.
Expert liability
4.1 Declaration of qualifications
The Expert declares on their honour the accuracy of the qualifications, training and certifications displayed on their profile. GutUp Sàrl reserves the right to request supporting documents and to suspend any account whose declarations prove inaccurate.
4.2 Editorial obligations
The Expert is solely responsible for the accuracy, relevance and regulatory compliance of all published content. They guarantee that their publications:
- comply with claims authorised by Regulation (EC) No 1924/2006
- do not constitute acts of care within the meaning of the Health Professions Act
- do not publish information likely to lead a user to modify or discontinue medical treatment
- explicitly mention any contraindications
- correspond to their declared qualifications
4.3 Penalties
In the event of a breach, GutUp Sàrl reserves the right to:
- modify, hide or delete content without notice or compensation
- suspend or terminate the account
- hold the Expert civilly liable for any resulting harm
Producer liability
The Producer is solely responsible for the accuracy, completeness and update of their product sheets. They guarantee that:
- the composition, nutritional values and allergens comply with legal labelling requirements (FOSCO/OFoodA)
- claims comply with Regulation (EC) No 1924/2006
- certifications and labels displayed are valid
- any changes are reflected within 48 hours
The Producer indemnifies GutUp Sàrl against any third-party claim resulting from inaccurate or outdated information.
Spot liability
The Spot is solely responsible for the accuracy and update of its information: opening hours, address, offers, prices, descriptions and certifications. It undertakes to update this information within 48 hours of any change.
The Spot guarantees that its descriptions contain no non-compliant health claims, no misleading information within the meaning of the Swiss Unfair Competition Act, and no references likely to mislead users.
B2C user reviews and comments
The User is solely responsible for all content they publish on GutUp.
By publishing a review, the User guarantees that:
- their review is genuine and based on a real personal experience
- they have received no compensation for publishing it
- they are not publishing under a false identity or on behalf of a third party
- they are not themselves the Expert, Producer or Spot being reviewed
Published content must be:
- free of defamatory, abusive or discriminatory statements
- free of therapeutic claims (personal testimonials about a felt improvement in wellbeing are welcome)
- free of photos of identifiable persons without their consent
- free of confidential information shared with an Expert
- free of disguised advertising
Any Expert, Producer or Spot subject to a review may submit a single public response via their dashboard. This response must remain factual and professional.
In the event of a breach:
- First breach: content removed and written warning by email
- Second breach: content removed and temporary account suspension (30 days)
- Serious breach (defamation, misleading medical claim, identity theft): immediate termination without notice or compensation, possible referral to the relevant authorities
User-generated content: Hosting status
GutUp Sàrl acts as a host within the meaning of the Swiss Federal Act on Online Media Services and the European e-Commerce Directive. As such, GutUp Sàrl exercises no systematic monitoring or prior review of content published by users. Reviews and comments are published automatically, without validation by GutUp Sàrl.
GutUp Sàrl cannot be held liable for content published by a user, unless, having been effectively informed of its manifestly unlawful nature, it failed to act promptly to remove it or block access to it.
Any user may report inappropriate content using the Report button available on each publication, or by email at hello@gutup.ch. GutUp Sàrl undertakes to handle any report within 5 business days of receipt.
When a review is published on an Expert partner's profile or content, the Expert is notified via their partner dashboard. The Expert has a direct report button in their dashboard to alert GutUp Sàrl to any content they consider to be in breach of the rules set out in Article 7.
Personal data
GutUp Sàrl processes personal data in accordance with the Swiss Federal Act on Data Protection (nFDP) and the GDPR for users residing in the European Union. Data collected is used exclusively for the purposes of operating the platform and is never sold to third parties.

Community guidelines
The GutUp community is a space dedicated to nutrition, gut health and wholesome eating.
We encourage:
- exchanges based on personal experience and genuine testimonials
- open questions about nutrition and the microbiome
- sharing of recipes and gut-friendly discoveries
- a supportive attitude towards each person's journey
The following are prohibited:
- discriminatory, hateful or harassing statements
- promotion of extreme diets or dangerous eating behaviours
- unsolicited advertising for products or services outside GutUp
- identity theft or the creation of fake profiles
- sexual or violent content
- content infringing third-party intellectual property rights
- unfounded therapeutic claims
General provisions
Changes to the Terms
GutUp Sàrl reserves the right to modify these Terms at any time. In the event of a material change, you will be notified by email at least 30 days before the change takes effect. Continued use of the platform constitutes acceptance.
Governing law and jurisdiction
These Terms are governed by Swiss law. In the event of a dispute, the Cantonal Court of Vaud (Lausanne) shall have sole jurisdiction, subject to the mandatory provisions applicable to consumers residing in the European Union.
